Terms and conditions

To ensure everyone has the best experience at Midlands Arts Centre (MAC), tickets are subject to these terms and conditions of sale.

Tickets are sold by Midlands Arts Centre: registered company no. 718349, registered charity no. 528979.

MAC sells tickets both on behalf of the organisation/venue itself and acting as an agent for Promoters and Organisers hiring a) the venue or b) the sales service in respect of an event staged at another venue unconnected with Midlands Arts Centre or Midlands Arts Centre Trading Ltd.

1. Credits, exchanges and refunds

1.1. We will only refund, exchange or credit your tickets if the event is cancelled.

1.2. We cannot refund, exchange or credit your ticket if at least half the running time of the event has elapsed.

1.3. If the event is rescheduled before the planned start time, we will transfer your ticket to the new date/time as a first measure. If you are unable to attend the new date/time we will credit or refund your account.

1.3.1. If multiple performances/screenings of the same title are available, we may transfer tickets where possible, but this is at our discretion.

1.4. Outdoor events will go ahead, unless deemed unsafe due to extreme weather conditions by the duty management team and the above clauses will apply in relation to credits, exchanges and refunds.

1.5. Tickets are not transferable and their re-sale for profit or commercial gain or use in promotions and packages without our express permission is prohibited and may render them void.

1.6. Tickets will not be accepted for re-sale unless the event in question is sold out. The re-sale of any tickets cannot be guaranteed. For any tickets accepted for re-sale, MAC will retain the booking fee.

2. Prices, concessions, discounts & fees

2.1. All attendees must have a valid ticket for the event. Prices may vary according to demand. MAC reserves the right to introduce price changes and discounts at any time without offering refunds.

2.2. A non-refundable booking fee is added to the advertised ticket price. This covers administration and is invested back into the organisation to maintain the services and activities you experience during your visit to MAC.

2.3. Where possible, concessionary tickets are available to under 16s on price bands A and B and we offer free companion spaces for those with access needs.

2.4. Concessionary tickets must be requested at the time of booking as the discount cannot be applied retrospectively

2.5. Where applicable, MAC will aim to advise customers regarding suitability of a show for children

2.6. Some events at MAC are advertised with age restrictions and we may ask for proof of age at the point of admission

2.7. MAC is not liable for lost, destroyed or stolen tickets and we cannot always replace them. Altering your ticket may render it void.

3. Customer comfort & security

3.1. Latecomers are not eligible for a refund.

3.2. If your behaviour is contrary to our Code of Conduct, we reserve the right to refuse admission or remove you from the venue, without a refund

3.3. We reserve the right to transfer you to an alternative seat if an event is moved to an alternative location or the seating layout changes after you’ve booked

3.4. We reserve the right to refuse admission to people carrying prohibited items, e.g. glass bottles, items that could be used as a weapon or recording equipment

3.5. We reserve the right to make reasonable alterations to the advertised event, programme or casting without any obligation to refund monies or exchange tickets

3.6. We reserve the right to cancel or abandon any event without notice and without liability for compensation or damage other than up to a full refund of the ticket price paid.

3.7. We are unable to accept responsibility for any damage to, or loss of property at MAC.

3.8. MAC cannot be held responsible for any disruption in the local area relating to major events (e.g. cricket matches, park events) which may lead to potential difficulties in parking or arriving at MAC.

3.8.1. MAC is not responsible for issuing information or updates relating to external events. However where possible we will aim to alert users, if we are notified in advance. On such occasions, please allow extra time to get to and park at MAC and check local news channels.

3.9. The unauthorised use of mobile phones, cameras, video, digital or sound recording is prohibited at all events.

4. Your data

4.1. All tickets are sold subject to General Data Protection Regulations.

4.2. MAC does not sell data to third parties.

4.4 By attending an event you consent to being filmed/recorded as part of the audience for security, broadcast or promotional reasons, without payment

5. Terms and conditions specific to MAC courses

Payment

5.1. Full payment or a £30 deposit is required to secure a place on a course.

5.1.1. Any outstanding balance must be paid 3 weeks prior to the start of the course. If you inform us that you do not wish to attend that course, your deposit will be saved as credit on your account for 24 months. After this time, your deposit will become a charitable donation to MAC.

5.2. A learning programme can only be attended following full payment and on presentation of a valid ticket. Tickets for a course will be collected from students and validated by their artist tutor at their first course session.

Course changes

5.3. If during a course, a course session is cancelled due to unforeseen circumstances, we will attempt to find a substitute artist tutor or we will arrange a replacement session/s.

5.3.1. Replacement sessions are usually achieved by extending the learning programme by a week at the end of term and/or arranging a session during the half term week.

5.3.2. MAC reserves the right to schedule a replacement session outside of the published term dates without offering a refund as an alternative. On the rare occasion that MAC cannot arrange a replacement session, MAC may offer a partial refund of course fees.

5.3.3. If a course is cancelled before the start date, students will be given the opportunity to transfer to another course where feasible or offered a full refund. To assist this, we encourage you to give full contact details at point of booking.

5.3.4. In the unlikely event of a learning programme that is already under way experiencing a fall in student numbers below the minimum threshold, MAC reserves the right to cancel the course at short notice, however we will make every effort to find a suitable alternative in the first instance or to offer a refund for any remaining sessions.

5.3.5. Minor changes of course content or a change of artist tutor will not be considered to affect our cancellation policy

5.4. Non-attendance of classes due to illness, or for personal or professional reasons does not provide the right to refunds, extra tuition or transferral to another class.

5.5. Artist tutors cannot cancel and/or rearrange sessions for students who for any reason cannot attend their class.

5.6. Children cannot attend courses for adults. Ages 16 - 17 may be able to enrol on select adult courses if accompanied by a paying parent or guardian but you must contact us to discuss this in advance of booking

5.7. All MAC Artist Tutors and Learning Support Workers are DBS checked and work within MAC’s Safeguarding Policy.

Transfers

5.8. Depending on availability if after one session, you decide that the learning programme you have enrolled on is unsuitable and you notify us in writing within 48 hours, we will endeavour to transfer you to another programme of your choice within the same term, however this is not guaranteed.

5.9. Where a suitable transfer is not possible or is declined, we regret that refunds cannot be issued.

5.10. If there is a difference in price between the two learning programmes you will be asked to pay the balance upon collection of the new ticket or the credit will be issued to you

Student conduct

5.11. Learning programme participants are expected to conduct themselves in a respectful manner and to recognise that other participants also require support and assistance. Please refer to MAC’s Code of Conduct.

Health & safety

5.12. Should a student with access needs wish to bring along a carer, that person should be there to assist them rather than participate in the class.

5.13. We do not accept safeguarding responsibility for participants under 18 without completed participation enrolment forms signed by a parent/guardian. We reserve the right to refuse admittance to an activity without a completed form.
